1908 Deed of Sale to Clara Hamma from Ollie B. Abbott

Ollie B. Abbott & Elmer D. Abbott to Clara Hamma

Know all men by these presents: That OLLIE B. ABBOTT and ELMER D. ABBOTT (her husband) in consideration of SIXTY EIGHT HUNDRED DOLLARS ($6800.00) to them paid by CLARA HAMMA the receipt whereof is hereby acknowledged, do hereby Grant, Bargain, Sell and Convey to the said CLARA HAMMA her heirs, and assigns forever, the following described real estate: Situate in the City of Springfield, County of Clark, and State of Ohio, and bounded and described as follows. viz:

Being Lot Number Thirty seven hundred and seventy-seven (3777) on the plat of Wittenberg College in addition of the City of Springfield.

It is a condition of this deed that if the said grantee, her heirs or assigns, shall permit the manufacture, sale or traffic of intoxicating liquors on said premises, then the same shall be forfeited and the premises hereby conveyed shall revert to the grantor herein.

Being the same premises conveyed to said Ollie B. Abbott by deed to Ella I. McMillen (widow), dated December 29th, 1905, and recorded in Vol. 153, page 70 of the Clark County Deed Records.

And all the Estate, Title and Interest of the said grantors either in Law or Equity, in and to the said premises; Together with all the privileges and appurtenances to the same belonging: to have and to hold the same to the only proper use of the said grantee her heirs, and assigns forever. And the said grantors for themselves and their heirs and administrators, hereby Covenant with the said grantee her heirs, and assigns, that they are the true and lawful owners of the said premises, and have full power to convey the same; and that the title so conveyed is Clear, Free and Unincumbered; And further, that they will Warrant and Defend the same against all claims of all persons whomsoever; except as to taxes and assessments due June 20th, 1909 and all subsequent taxes or assessments; grantors, however, agreeing to pay full amount of sewer assessments now a lien on said premises

In Witness Whereof, the said Ollie B. Abbott and Elmer D. Abbott (her husband) who hereby releases all his right and expectancy of Dower in the said premises, have hereunto set their hands this seventeenth day of October in the year of our Lord one thousand nine hundred and eight.

Be it remembered, that on this 17th day of October, in the year of our Lord one thousand nine hundred and eight, before me, the subscriber, a notary public in and for said county, personally came Ollie B. Abbott and Elmer D. Abbott (husband and wife) the grantors in the foregoing Deed, and acknowledged the signing thereof to be their voluntary act and deed.
