1892 Deed of Sale to Flora E Winger

Flora E Winger and Husband to Ella I McMillen

Know all men by these Presents that Flora E Winger and John M Winger her husband of the County of Clark and the State of Ohio for and in consideration of the sum of Five Thousand Two hundred dollars to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained, and sold and by these presents do grant bargain, sell, convey, and confirm unto Ella I McMillen of the Clark County and State of Ohio her heirs and assigns all the following described real estate with the appurtenances situate in the city of Springfield, County of Clark and state of Ohio and bounded and described as follow viz:

Being lot number thirty seven hundred and seventy seven (3777) on the plat of Wittenberg College, in addition to the city of Springfield.

It is a condition of the deed that if the said grantee, her heirs or assigns shall permit the manufacture, sale or traffic of intoxicating liquors on said premises then the same shall be forfeited and the premises hereby conveyed shall revert to the grantor herein.

Being the same premises conveyed to said grantors by deed of John Myers and wife dated July 19” 1886 and recorded in vol 89 page 337 & 338, Deed Records Clark County Ohio, and all the estate title and interest of the said grantors either in law or in equity of in and to the said premises; Together with all the privileges and appurtenances to the same belonging, and all the rents issues, and profits thereof(.)

To have and to hold the same to the only proper use of the said grantee her heirs and assigns forever.

And the said Flora E Winger and John M Winger her Husband for themselves and their heirs, executors and administrations, do hereby convent with the said grantee her heirs and assigns, that they are the true and lawful owners of the said premises, and have full power to convey the same; that the title so conveyed is clear, free and unincumbered; and further that they do warrant and will defend the same against all claim or claims of all persons whomsoever.

In witness whereof the same Flora E Winger and John M Winger her husband who hereby releases his right and expectancy of dower in said premises have hereunto set their hands this seventeenth day of October in the year of our Lord one thousand eight hundred and ninety two

Be it remembered that on the seventeenth day of October in the year of our Lord one thousand eight hundred and ninety two before me the subscriber, a notary public in and for said county personally came Flora E Winger and John M Winger the grantors in the foregoing deed and acknowledged the signing thereof to be their voluntary act for the uses and purposes therein mentioned.

In testimony whereof I have hereunto subscribed my name and affixed my official seal in the day and year last aforesaid.
