1883 Deed to John Myers


Deed of Sale to John Myers from D. R. Hosterman

 D. R. Hosterman  and Wife to John Myers

Know all men by these presents: that D. R. Hosterman & Harriett A. Hosterman his wife of Clark County Ohio, in Consideration of Twelve hundred fifty Dollars to them paid by John Myers of same County and State, the receipt where of is hereby acknowledged, do hereby grant, bargain sell, and convey to the said John Myers, his heirs and assigns forever, the following described Real Estate situated in the County of Clark in the State of Ohio, and in the City of Springfield.

Being Lot number, Thirty Seven Hundred and Thirty Seven (3777,) on the plat of Wittenberg College in addition to the City of Springfield. It is a condition of this deed, that if the said John Myers, or his heirs or assigns, shall permit the Manufacture, sale or traffic of intoxicating liquors on said premises, then the same shall be forfeited, and the premises hereby conveyed shall revert herein —Being the same premises conveyed to said D. A. Hosterman, by deed recorded in volume 80 page 438, Deed Records of Clark County Ohio —

To have and to hold said premises, with all the privileges and appurtenances thereunto belonging to the said John Myers, his heirs, and assigns forever.

And the said D. R. Hosterman for himself and for his heirs, executors and administrators, does hereby covenant with the said John Myers his heirs and assigns that he is lawfully seized of the premises aforesaid, that the title, so conveyed, is clear and free from all incumberances whatsoever, and that he will forever warrant and defend the Same unto the said John Myers, his heirs, and assigns, against the lawful claims of all persons whomsoever Except as to a certain mortgage claim of $ 750.00 with interest, given to the Board of Directors of Wittenberg College by said Hosterman in part purchase of same, which said Myers assumes and hereby agree to pay in.

In witness whereof, the said D. R. Hosterman and Harriett A. Hosterman his wife, who hereby relinquishes her right and expectancy of dower in the premises, have hereto set their hands and seals, this 17th day of May, in the year of our Lord One thousand Eight hundred and Eighty three.

The State of Ohio, County of Clark, ss.

Be it remembered, that on this 17th day May, in the year of our Lord, One Thousand Eight hundred and Eighty-three, before me the subscriber a Notary Public in and for said County, personally came the above named D R Hosterman and Harriet A. Hosterman his wife, the grantors in the foregoing Deed and acknowledged the signing and sealing of the same to be their voluntary act and deed, for the uses and purposes therein mentioned. And the said Harriet A. Hosterman wife of the said husband and the contents of said instument (?) being by me made known and explained to her as the statute directs, then declared that she did voluntarily sign, seal and acknowledge the same, and that she is still satisfied therewith as her voluntary act and deed for the uses and purposes therein mentioned.

In testimony whereof, I have hereunto subscribed my name, and affixed my notarial seal, on the day and year last aforesaid.
